Agility 125 / My new Agility keeps dieing then restarts when cold

I have just purchased my new 2009 Agility 125 delivered with zero milage.... love it but it keeps dieing of petrol starvation !!!!! 
(my interpretation of the problem) it just dies after about 2 km then once it goes cold it fires up again no problem ......................... 2 more Kms and the same problem ................ does it have a fuel filter .... or has anybody had the same problem..... would love to drive it more than 2 kms
