People 50 from New Mexico

Someone is offering a People 50 that is titled and (expired) reg in New Mexico.
I am in New York.

Does anyone know if a People 50 titled in New Mexico would be titled as a motorcycle or Moped?

In New York, they usually go by the top speed listed on the MSO, and the People 50 should be considered a B moped.

But would NM title a moped? New York does not - transferrable reg, no title.

So I am wondering if I would be able to reg it in NY as a moped.

Sounds like the only difference with a 50cc scoot is that you don't need the motorcycle license to operate - but otherwise do have to register and title in New Mexico. 

however, since you're in a different state then you would just go by your state laws - regardless of where the scooter came from before and how it was titled.

But you see, the question is this:
Since there is no MSO if the scoot title shows it as a motorcycle (which could happen with a 50cc in New York since they go by top speed as stated on the MSO not the cc) then NY would probably title it as a motorcycle, which is useless since someone with a motorcycle license has no real reason to buy a 50cc, and someone without can not ride it.

You'd have to check with the DMV, but I think that what matters is the VIN number - when they put that in their database it will come up as a 50cc and thus be classed as a moped B - or whatever they call it.

I'd give the DMV a call and ask them about it.
