carb or stator problem?

I have a 2009 people s250. Took it out tonight and it started to cut out when i got above 40 mph. It idles and revs fine. I always use high octane gas and over the past winter I always added sea foam when I filled up. I'm leaning towards the stator ???. I'm lucky that it's still under warranty.

Problem solved. Turns out when I stored the scoot in my shed for a couple of weeks to work on my motorcycle a family of mice moved in  the air filter box.
 When I took the air box cover off the filter was completely clogged with Insulation.
I looked in the shed that I just built last summer I found out  mice had moved in and used my roll of insulation in the corner as bedding in the air filter box. I need to borrow my neighbors cat. :D

Thanks zombie, I think the mice have moved out. I've set out a few traps to see what happens.

Mix a bottle of Tabasco sauce, and a box of Cayenne pepper. Pour it around the area, and they will move. I had RATS in a shop, an didn't want to kill them so I made them Wish they were dead.

I can't hurt them either. We have a pretty big black bear issue here, and the City Hall has petitioned Game, and Fish to allow "Culling" (killing) some for a specified time. I responded that every bear "culled" will result in an equal action on MY part. Of course I was asked to leave but my Point was discussed at length by the rest, and the motion was pulled.  Some times a Dictator in the mix helps.
